PRIVACY POLICY

This is the Privacy Policy (“Policy”) of www.nddpp.com, a website used to access the State of North Dakota’s deferred presentment transaction (“DPT”) database pursuant to the State of North Dakota Century Code sections 13-08-01, 13-08-06, and 13-08-12 relating to deferred presentment service transactions (the “Act”).

Who we are.

The website is an online service of Veritec Solutions, LLC (“Veritec”) that allows North Dakota licensed lenders offering DPTs to validate consumer eligibility pursuant to the Act, and in accordance with regulations promulgated thereunder by the North Dakota Department of Financial Institutions (“DFI”) to provide for the tracking of information regarding all such transactions. Veritec is a third party, privately held company under contract with the DFI to provide the database.

Privacy Notice.

Privacy and security are our highest priority – ensuring lawful electronic access to DPT information while maintaining privacy is a guiding principle of our program. Personal data in our possession is maintained and used in ways that respect individual privacy. Veritec educates its employees about the importance of protecting personal information and privacy, and only authorized employees of Veritec and the DFI have access to personal information.

The purpose of this Policy is to notify you:

1. What personally identifiable information is collected through the website;
2. The organization collecting the information;
3. How the information is used;
4. With whom the information may be shared;
5. The kind of security procedures that are in place to protect the loss, misuse or alteration of information under our control; and
6. How you can correct any inaccuracies in the information.

Information we collect through the NDDPP website.

If you fill out the "Contact Us" form, your name and other identifying information will not be sold or shared with any person or organization, other than the DFI. Your e-mail address or telephone number may be used by authorized NDDPP employees to contact you concerning your comments, questions or complaints.

How your information is used.

When a lender enters borrower information into the database, we use the information to determine eligibility for a DPT including renewals pursuant to the Act. The results of the eligibility determination are returned to the lender.

The information contained in the database is authorized by the Act. Your information and the results of the eligibility determination may also be used by the DFI for purposes consistent with the laws of the State of North Dakota.

We do not sell or rent information to third parties for marketing programs or for any other purpose.

Limited distribution of personal information.

At the direction of a lender (when the "Submit" button is clicked), the information provided to us will be processed through the NDDPP system and the appropriate response will be returned to the lender. All the lenders in our network operate under federal and/or state laws and regulations. NDDPP will treat information sent indirectly through a lender in the same manner that it treats the information sent directly through the website.

Security.

The website has security measures in place to protect against the loss, misuse and alteration of the information under our control. Veritec uses the Secure Sockets Layer (SSL) protocol to safeguard sensitive personal information during online transactions. Using this widely accepted form of encryption, your transaction is secured from a lender’s personal computer to the Veritec computers processing the request, and the processing computers are located behind a secure firewall. This method protects your information.

This notice should not be construed in any way as guaranteeing, or warranting as fail proof, the security of information exchanged between lenders and Veritec.

Any changes to this our privacy policy will be communicated through the website at least 30 days in advance of implementation. Information collected before changes are made will be secured according to the Policy in effect prior to the change.

This website contains links to other websites. Please be aware that we are not responsible for the privacy practices of such other websites. We encourage our users to be aware when they leave our website and to read the privacy statements of each and every website that collects user information. This privacy statement applies solely to information collected by this website.

Cookies.

A cookie is a piece of data stored on the user’s hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our website. Once the user closes their browser, the cookie simply terminates. For instance, by setting a cookie on our website, the user would not have to log in a password more than once, thereby saving time while on our website. Users who reject the cookie may still use our website. The only drawback to this is that the user may be limited in some areas of our website.
